The judgment of the court below is reversed.

The defendant is innocent. The summary of this judgment shall be notified publicly.

1. In full view of the following facts: (a) the Defendant’s statement of the grounds for appeal (misunderstanding of the facts) is not consistent; (b) there is no credibility; (c) the former phrase, N, andO’s statement contained in the box of H products conforms to the facts charged; and (d) the conviction was pronounced in the relevant case; and (c) the fact that the Defendant indicated or advertised that the Defendant had efficacy, efficacy, or effect in preventing and treating diseases or that there is possibility of misconception or confusion as medicine; (d) however, the lower court erred by misapprehending the facts and acquitted the Defendant.

2. An ex officio determination prosecutor is a person who operates G, which is a regional cultural center of F (ju), the selling company of functional health foods in Jung-gu Seoul Metropolitan Government E, with the facts charged in the instant case.

No one shall indicate or advertise the efficacy or effect of a disease in the prevention and treatment of health functional foods, or the misunderstanding or confusion thereof with regard to the name, raw materials, manufacturing methods, nutrients, ingredients, methods of use, quality, and tracking and management of records of health functional foods.

그럼에도 불구하고 피고인은 2014. 9. 22. 경부터 2015. 6. 30. 경까지 위 G에서 건강기능식품인 H은 ‘H에는 초석 잠이 재료로 들어가 있는데 간, 장 기능을 활성화 시키고 고혈압 예방에 탁월하며 엉겅퀴가 들어 있어 간 질환 및 손상된 간세포 재생을 유지하는데 도움이 된다’ 라는 내용이 기재된 전단지를 보여주거나, 위 H 제품 상자 속에 들어 있는 ‘ 녹차 - 항암, 노화, 고혈압, 비만에 효과가 탁월함, 다시마 - 풍부한 식이 섬유로 당뇨, 갑상선, 대장암, 변비에 도움이 됨, 프로 폴리스 - 항암효과, 면역력 강화, 위궤양 개선에 탁월함, 초석 잠 - 고혈압 예방에 탁월함’ 이라는 내용의 전단지를 배포하는 방법으로 불특정 다수의 사람들에게...
