The defendant shall pay 435,00,000 won to the plaintiff and 12% per annum from July 3, 2020 to the day of complete payment.

1. According to the purport of Gap's evidence No. 1 and all pleadings as to the cause of the claim, it is recognized that the defendant prepared a certificate of borrowing that "the defendant would repay KRW 435,000,000 borrowed from the plaintiff to December 31, 2019" on July 26, 2019.

According to the above facts, the defendant is obligated to pay 435,00,000 won to the plaintiff up to December 31, 2019. Thus, the defendant is obligated to pay to the plaintiff 435,000,000 won and damages for delay calculated by the ratio of 12% per annum as stipulated by the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from July 3, 2020 to the date of delivery of the copy of the complaint of this case (the original copy of the payment order) to the date of full payment.

2. It is so decided as per Disposition by the assent of all participating Justices on the ground that the plaintiff's claim is justified.
