A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person engaged in driving three cargo vehicles in sealed B.

1. On April 22, 2016, the Defendant: (a) violated the Act on the Aggravated Punishment, etc. of Specific Crimes; (b) violated the Act on the Aggravated Punishment, etc. of Specific Crimes (i.e., escapeing vehicles); and (c) violated the Road Traffic Act (i.e., violation of the Act on the Aggravated Punishment, etc. of Specific Crimes; (b) operated the said cargo vehicle under the influence of alcohol concentration of 0.167% during blood transfusion; and (c) led the front road in Jindo-gun C, Jindo-gun to turn to the right of left from the tide of the gold market.

Since it is a narrow road at that time, a person engaged in driving of a motor vehicle has a duty of care to safely drive the motor vehicle by checking well the right and the right of the front side.

Nevertheless, as above, in order to make a left-hand turn due to the influence of drinking, the victim E(49) who temporarily stops to turn the right-hand turn to the early left-hand side due to the negligence of making it difficult to drive the car normally, the driver's length of the car at hand and the front wheel part of the driver's seat of the defendant E(49).

2. On April 22, 2016, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused before the risk) driving the foregoing cargo vehicle while under the influence of alcohol content 0.167% during the blood transfusion on April 11, 2016.
