1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. The Plaintiff’s assertion was revoked on March 28, 201, when he/she joined J Co., Ltd. (hereinafter “Nonindicted Company”) on March 15, 2002 and was appointed as the head of the Korea Trade Union L branch on February 10, 201 and worked as the head of the Korea Trade Union L branch on February 10, 201.
During that period, the Defendants’ illegal interference with the election of the Defendants were delayed, and the Plaintiff’s term of office expired, and Nonparty Company was dismissed on April 30, 2016 on the ground that the Plaintiff was the Plaintiff, but the Plaintiff was not reinstated.
Since then, the Plaintiff received an order for unfair dismissal relief from the Gyeongnam Regional Labor Relations Commission, and was reinstated on April 27, 2018 through administrative litigation, etc.
The Defendants’ interference with the election of the head of the branch office did not result in the failure of the head of the branch office before the expiration of the Plaintiff’s term. If the Plaintiff was reappointed to the head of the branch office before the expiration of the term of office, the Nonparty Company could not dismiss the Plaintiff.
Nevertheless, the defendants were aware of these circumstances and interfered withhh with the election of the branch head of L branch, which led to the plaintiff's improper dismissal.
Therefore, the defendants should compensate the plaintiff for consolation money for each tort.
2. The plaintiff's failure to acknowledge that there is a proximate causal relation between the plaintiff's failure to obstruct the election of the head of the branch office of the defendants and the plaintiff's improper dismissal on the sole basis of the evidence submitted by the plaintiff, and there is no other evidence
3. It is so decided as per Disposition by the assent of all participating Justices on the ground that the plaintiff's claim of this case is without merit.
