A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[criminal history] On March 17, 2008, the Defendant was sentenced to a summary order of KRW 1 million for a crime of violating road traffic law in the Seo-gu District Court Branch of the Daegu District Court on March 17, 2008; the Defendant was sentenced to a summary order of KRW 3 million for the same crime at the Daegu District Court on October 31, 2014; and on October 13, 2015, the Defendant was sentenced to a suspended sentence of KRW 6 months for the same crime.
[Criminal facts] The Defendant is a person who is engaged in driving a vehicle B K7 vehicle volume.
1. On September 3, 2017, the Defendant driven the said vehicle under the influence of alcohol content of about 2km from around 08:07 to around 08:01% of alcohol content in blood, from around 2km to the middle-dong in the middle-dong of Daegu Suwon-dong.
2. On September 3, 2017, the Defendant violated the Act on Special Cases Concerning the Settlement of Traffic Accidents (Bodily Injury) led to the direction of the four-distance distance from the middle side of the middle school in the middle school of the Daegu hydro-gu Suwon-gu.
