A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

No game products related business entity shall allow any person to gamble or perform other speculative acts using a game product, or leave such person to do so.

The Defendant is the proprietor operating a game room in the trade name “C” from February 2, 2019 to February 20, 2019, and D is the employee of the said business.

피고인은 2019. 2. 2.경부터 2019. 2. 20.경까지 위 게임장에서 ‘씨엔블루’ 30대, ‘꿀꿀이포커’ 20대, ‘유니월드포커’ 20대를 설치하여 위 게임장을 방문한 불특정 다수의 손님들에게 게임물을 제공하고, 종업원에게 손님들이 게임물을 통해 획득한 점수를 이전해줄 것을 요청하는 경우 이에 응하여 점수를 이전해 줄 것을 지시하는 등 종업원 관리를 하고, 종업원 D은 손님들이 위 게임물의 이용을 통하여 획득한 점수를 현금 거래한다는 것을 알면서도 태블릿PC에 저장된 회원정보를 확인한 후, 게임기에 현금을 투입하여 손님들 간 점수를 이동해주는 방법으로 손님들이 서로의 점수를 현금과 교환하여 게임을 하게 하였다.

Accordingly, the defendant in collusion with the above D, caused customers to engage in gambling and other speculative acts using game products, or left them to do so, by inducing them to accumulate and transfer points to facilitate exchange among customers.
