AA shall be punished by imprisonment with prison labor for ten months, and by imprisonment with prison labor for one year.
Defendant A, however, is subject to this.
Reasons
Punishment of the crime
[Criminal Justice] On September 25, 2014, Defendant A was sentenced to three years of suspension of the execution of imprisonment with prison labor for fraud, etc. at the Seoul Eastern District Court on September 25, 2014, and the said judgment became final and conclusive on October 3, 2014. On November 7, 2014, Defendant A was sentenced to three years of suspension of execution for one year of imprisonment with prison labor at the Seoul East East Eastern District Court for fraud, etc., and the said judgment became final and conclusive on February 6, 2015. Defendant A was sentenced to three years of imprisonment with prison labor at the Seoul East East District Court for fraud, etc. on the 25th of the same month.
【Criminal Facts】
[2015 order 15] The Defendants conspired to forge another person's lease contract, etc. to offer it as security to the victim AE and to acquire money from the victim as a loan.
1. On May 2012, Defendant A, at the subway station located in Yeongdeungpo-gu Seoul Metropolitan Government on the date, issued one of the following: (a) one hundred thousand won and Defendant AA’s identification card, etc. to the name “D” at the coffee shop located in Yeongdeungpo-gu Seoul Metropolitan Government; (b) requested that the apartment lease contract in the name of AF be forged; and (c) “D” written “location: 103 Dong-dong 601, Dongdaemun-gu, Seoul Metropolitan Government; (c) deposit: 280,000,000, and (d) sealed AF’s name and sealed thereon.
As a result, the Defendants forged one apartment lease contract in the name of AF, a private document related to rights and obligations, in collusion with D.
2. On August 2, 2012, the Defendants issued the forged apartment lease contract form as if it were a document duly formed, as in paragraph (1), to AE who is unaware of the fact in Seoul Dongdaemun-gu AG apartment 103 Dong 601, Dongdaemun-gu Seoul.
Accordingly, the Defendants conspired to use the forged private document.
3. The fraud defendant A was killed in the name-free box who will play the role of AF, the head of the house, at the time and place set forth in Paragraph 2, and the defendant A had the victim AE in Seoul.
