1. 특정범죄가중처벌등에관한법률위반(운전자폭행) 피고인은 2015. 7. 20. 19:25경 파주시 B에 있는 C 정형외과 앞에서 피해자 D(49세)가 운행하는 택시를 일행과 함께 타고 온 후 일행이 택시비를 계산하는데 피해자가 콜비를 받는다는 이유로 갑자기 ‘문산 택시가 왜 금촌에서 운행하고, 콜비는 왜 받냐, 개새끼, 씹새끼’라고 욕설하고 피해자가 뒤 차량들의 교통을 위해 택시를 움직이자 손바닥으로 피해자의 목 부위를 1회 내리치고 이에 깜짝 놀란 피해자가 택시를 세우자 피해자를 강제로 내리게 한 후 손바닥으로 머리와 뺨을 때려 폭행하였다.

On July 20, 2015, around 19:57, the Defendant: (a) expressed that the Defendant arrested the Defendant as a flagrant offender, the police officer of the Pakistan Police Station G District, who was dispatched to the scene after receiving 112 reports of the instant assault case from “F Pharmacy” in front of the instant assault case, and that “I see, rings, the police officer of the Republic of Korea sees the Defendant as a flagrant offender; and (b) assaulted H’s chest one time to the floor of hand.

Accordingly, the defendant interfered with the legitimate execution of duties by police officers on handling 112 reported cases and arrest of flagrant offenders.
