1. The defendant shall be punished by imprisonment for six months;

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Intimidation;

가. 피해자 M 1) 피고인은 2011. 8. 26. 12:19경 부산 시내 불상지에서 피해자 M의 휴대전화기로 전화를 걸어 “너는 대가리 깎아버린다 이새끼야 너는, 너는 재판정에 서면 죽이뿐다 개새끼 너는”고 말하고, 같은 날 12:29 다시 피해자에 전화를 걸어 “인마, 내 눈깔에 뛰면 니는 죽어, 이 새끼야”라고 말하여 협박하였다. 2) 피고인은 2011. 8. 27. 19:18경 부산 시내 불상지에서 피해자 M의 휴대전화기로 전화를 걸어 “씨발놈 배때지에 칼 맞기 전에, 니 어깨에 힘주다가 배때지에 칼 맞기 전에 윽 하지 말고, 힘주다가 새끼야 윽 하다가 배때지 칼 맞고 윽 하지 말고, 좆만한 새끼가 어디서 쌔기, 뒤질려고 젊은 나이에 (중략)..너 씨발놈 내일 모레 한 번 봐라, 니 개새끼 찾으면 배때지 확 칼침 놔 버린다, 니”라고 말하여 겁을 주었다.
