Judgment of the first instance.

1. Facts of recognition;

A. On September 15, 2014, the Plaintiff entered into a lease agreement with a co-defendant Co-Defendant, Co-Defendant, Ltd., Co-Defendant, Ltd., Ltd. (hereinafter “original name”) to lease various temporary materials, such as oil pumps, meritorious plates, pipes, etc. (hereinafter “the instant temporary materials”), and to pay in cash within 15 days from the end of each month, as the company engaging in the manufacture, sale, etc. of building materials and temporary materials (hereinafter “the lease agreement for temporary materials”).

B. At the time, the Defendant jointly and severally guaranteed the obligation owed to the Plaintiff with respect to the lease contract for temporary materials.

C. On December 31, 2014 and January 6, 2015, the Chang Name sent a mail verifying the purport that “The total amount of 19,849,691 won for temporary materials was unpaid from September 2014 to December 6, 2015, the Plaintiff sent the instant temporary materials to the Defendant and Chang Name, and the Plaintiff was sent to the Defendant and Chang Name, along with legal process. The instant temporary materials are demanded to be immediately returned, and no longer used at the site.” The mail certifying the content was sent to the Defendant and Chang Name at that time.

Even after this, the temporary materials of this case were not returned, and all were recovered from the Plaintiff on August 24, 2015.
