A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant has been frequently at the shopping mall of the large population C in his house of the defendant in the vicinity of his house with frequent time with the merchants.

1. Interference with business;

가. 피고인은 2016. 7. 중순 00:00경 용인시 처인구 D에 있는 마트에서 술을 마신 상태로 들어가 이전에 위 마트 점장과 휴대폰 분실 문제로 시비가 되어 위 마트 직원인 피해자 E(여, 40세)에게 위 점장을 불러줄 것을 요구하며 말다툼하다가 피해자의 거부로 돌아갔다가 다시 돌아와 피해자에게 “왜 점장을 안 불러 주냐. 돼지 같은 년, 개 같은 년, 썅 년.”등의 욕설을 하면서 피해자를 계속 따라 다니며 약 30분 동안 소란을 피우는 등 위력으로써 위 마트 영업을 방해하였다.

나. 피고인은 2016. 7. 26. 20:50경 위 F에 있는 G 마트 가전코너에서 직원인 피해자 H(44세)이 피고인이 가져가려던 텔레비전에 대한 대금 완납을 요구하며 텔레비전을 가져가지 못하게 한다는 이유로 화가 나 피해자에게 “야 이 새끼야. 씨발 놈아. 조합장하고 이야기 끝났으니 어서 TV를 줘라.”라고 욕설을 하면서 약 20분 동안 소란을 피우고, 계속하여 그곳의 안내데스크에 근무하던 직원인 피해자 I(33세)에게 “이런 씨발 놈, 너 죽고 싶냐. 똑바로 살아라.”고 욕설하면서 2회에 걸쳐 전화기로 피해자의 얼굴을 때리려는 시늉을 하는 등 약 20분 동안 소란을 피워 위력으로써 위 G 마트의 영업을 방해하였다.

2.
