A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

The Defendant is a person who sells counterfeit items to the nation through the Internet SNS SNS (C) and NAV car page “E” in the two weeks’ name, “E” located in C Apartment Nos. 107, 101 and/or Do Government-si D.

1. 상표법 위반 피고인은 2015. 4. 12.부터 2016. 9. 23.까지 위 장소에서 불상의 중간 공급업 자로부터 공급 받은, 프랑스 ‘루 이비 통 말 레 띠에’ 사, 프랑스 ‘ 샤넬’ 사, 이탈리아 ‘ 구치 오구치 쏘시에 떼 퍼 아 찌 오니’ 사, 룩 셈 부르크 ‘ 프라다 에스. 에이.’ 사가 각각 대한민국 특허청에 그 지정 상품을 가방, 지갑 등으로 정하여 등록한 ‘루 이비 똥 (LOUIS VUITTON, 등록번호 4001255390000)' 과 동일 유사한 상표가 부착된 가방 약 1,243 점 및 지갑 약 1,658점, ' 샤넬 (CHANEL, 등록번호 4000713240000)' 과 동일 유사한 상표가 부착된 가방 약 199 점 및 지갑 166점, ‘ 구치 (GUCCI, 등록번호 4000703520000)’ 와 동일 유사한 상표가 부착된 가방 약 199 점 및 지갑 166점, ‘ 프라다 (PRADA, 등록번호 400350260000)' 와 동일 유사한 상표가 부착된 가방 약 199 점 및 지갑 166점 등 총 3,996점( 정품 시가 58억 230만 원) 을 인터넷 SNS 밴드( 대화명: E) 및 네이버 카페 ’E ‘를 통하여 불상의 도 소매업자에게 양도 또는 인도하고 별지 범죄 일람표 (1), (2), (3) 의 각 기재와 같이 그 대가로 248,647,180원을 받았다.

Accordingly, the defendant infringed the trademark rights of the victimized company.

2. From April 12, 2015 to September 23, 2016, the Defendant violated the Act on Regulation and Punishment, etc. of Concealment of Criminal Proceeds: (a) in mind that he/she sells counterfeit goods through the Internet SNS (Te.) and NAB carbook “To use a borrowed account in order to avoid the tracking of the investigation agency while selling them through the SNS; and (b) sells counterfeit goods to the Buddhist retailers as described in the items in paragraphs (1) and (2) of the attached List of Crimes in the attached Table; and (c) sells counterfeit goods to the third party and proceeds from such crime.
