Defendant
A shall be punished by imprisonment with prison labor for ten months, and imprisonment with prison labor for six months.
However, as to Defendant B, this shall not apply.
Reasons
Punishment of the crime
1. The Defendants’ co-principaled Defendant A, from April 201 to May 23, 2013, kept a false trademark in a warehouse located in Yongsan-gu Seoul Metropolitan Government D branch office No. 2, and sold them to persons whose name is not known. Defendant B, from April 2012 to April 1.5, 2012, was paid one million to Defendant A with a false trademark attached to the above warehouse and sold them to persons whose name is not known.

A은 2011. 4.경부터 2013. 5. 23.경까지, 피고인 B은 2012. 4.경부터 2013. 4. 8.경까지, 위 창고에서 위조 상표가 부착된 가방 및 지갑을 보관하면서 ‘루이비똥 말레띠에’의 등록상표인 ‘LOUIS VUITTON(등록번호 : 0109060호)’과 동일 또는 유사한 모양의 위조상표가 부착된 지갑 2,000점, 키지갑 500점, 상표권자 ‘샤넬’의 등록상표인 ‘CHANEL(등록번호 : 0071324호)'과 동일 또는 유사한 모양의 위조상표가 부착된 지갑 500점, 키지갑 500점, 상표권자 ’구치오구치쏘시에떼퍼아찌오니‘의 등록상표인 ’GUCCI'와 동일 또는 유사한 모양의 위조상표가 부착된 지갑 300점, 키지갑 50점, 상표권자 ‘프라다’의 등록상표인 ‘PRADA(등록번호 : 0404466호)’와 동일 또는 유사한 모양의 위조상표가 부착된 지갑 350점(판매가액 합계 최소 105,377,000원 이상) 등 위조상표가 부착된 지갑, 키지갑 등을 성명을 알 수 없는 사람들에게 판매하였다.
As a result, the Defendants conspired to infringe upon the trademark rights of the above trademark right holders.
B. On April 8, 2013, the Defendants were unable to identify the names of 254 points of the fake affixed with a forged trademark identical or similar to “LOIS VUTN (registration number: 0109060)” which is the registered trademark of the trademark right holder, in the foregoing warehouse.
