1. The Defendant’s KRW 129,223,143 and KRW 66,419,223 among the Plaintiff and KRW 51,676,310 from May 20, 2020.

From August 2018 to March 2020, the fact that the Defendant unpaid 54,797,697,690 won in total from 66,419,223 won in management expenses for commercial buildings and 8,006,230 won in arrears and 74,425,453 won in arrears and 51,676,310 won in arrears and 3,121,380 won in arrears from April 202 to October 2020 does not conflict between the parties.

Therefore, with respect to the Plaintiff, the Defendant is obligated to pay damages for delay calculated at each rate of KRW 129,223,143, and KRW 66,419,223 from May 20, 2020, the next day after the original copy of the instant payment order was served on the Plaintiff, and KRW 51,676,310 from November 25, 2020 following the day when a copy of the application for change in the cause of the instant claim was served on the Plaintiff, to the day when the Defendant rendered this decision, to dispute about the scope of the performance, 6% per annum under the Commercial Act, and 12% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from the next day to the day of full payment.
