1. The defendant shall be the plaintiff.

(a) deliver the real estate listed in the separate sheet;

(b) KRW 1,060,460 and this shall be applied to those KRW 1,00.

Reasons

1. Indication of claims: To be as specified in attached Form 1;

2. Judgment by service (Article 208 (3) 3 of the Civil Procedure Act).

3. Where a case is closed after May 31, 2019 pursuant to Article 2(2) of the Addenda (Presidential Decree No. 29768, May 21, 2019) as the provisions governing statutory interest rates under the main sentence of Article 3(1) of the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings for Partial Dismissal were amended by Presidential Decree No. 29768, May 21, 2019, the former statutory interest rate of 15% per annum from May 31, 2019; and 12% per annum from June 1, 2019 to the statutory interest rate under the amended provisions.

With respect to KRW 1,060,460, the Plaintiff claimed for the payment of damages for delay at the rate of 15% per annum as stipulated in the previous provisions from October 26, 2019 to the date following the delivery date of a copy of the complaint of this case. However, since the pleading was concluded after May 31, 2019, the legal interest rate of 15% per annum for the period asserted by the Plaintiff is not applicable, and it is ordered to pay damages for delay at the rate of 12% per annum as stipulated in the amended provisions.
