Defendants shall be punished by imprisonment for six months.

Provided, That with respect to the defendant A and C, each of the above punishments shall be executed for two years.

Punishment of the crime

Defendant

B is the mother and child relationship with Defendant C and Defendant A.

The Defendants, while entering coffee stores, restaurants, etc., presented a 100,000 won ticket while purchasing goods as customers, received some of them, deducted them, and then then calculated the remaining money again. In doing so, the Defendants were willing to commit fraud under the 100,000 won ticket by deceiving the victims as if they returned the total amount of said money, thereby deceiving the victims to return the 100,000 won ticket, and by deceiving the amount equivalent to the above deducted money from the victims.

1. On May 10, 2014, Defendant B and Defendant A conspired to purchase “H” restaurant operated by the victim G on the fourth and fourth floor of the F building B in Seongbuk-si, the market price of 5,000 won was 95,000 won by presenting a 100,000 won check from the employee, and received 95,000 won by using the 95,000 won by using the 5,000 won by using the 95,000 won by returning the 95,00 won, and in fact, the above 65,000 won by returning the 95,00 won by returning the 95,00 won by the employees, and by receiving the difference from the 30,000 won by receiving the 30,000 won by returning the 5,00 won check from July 27, 2010 to October 13, 2014.

On November 21, 2014, Defendant B and Defendant C conspired to purchase “K” coffee shop operated by the Victim J in Yangcheon-gu Seoul, Yangcheon-gu, Seoul, and received KRW 100,000 in the market price at KRW 6,00,000 from the employee, and received KRW 94,00 in the name of the employee, and returned the above check to the employee, with the amount of KRW 94,000,000, and actually returned the above check to return the total amount of KRW 94,000,000 in the name of the employee, and then acquired the difference of KRW 30,000 from the employee.
