Defendant shall be punished by a fine of KRW 500,000.
Where the defendant fails to pay the above fine, one hundred thousand won shall be one day.
Reasons
Punishment of the crime
1. At around 13:00 on February 28, 2015, the Defendant acquired one BC card owned by the victim B (n, 46 years old) on the front of the exit road No. 8, Nam-gu, Seoul, Seoul Special Metropolitan City, Seoul, on the road.
The Defendant, without taking necessary procedures such as returning the acquired property to the victim, embezzled the property that he/she had in mind.
2. On February 28, 2015, around 13:37, the Defendant purchased approximately KRW 9,800, such as bean, C, in the “Dovamarket” located in Gwanak-gu in Seoul Special Metropolitan City, and presented the card obtained to his/her employees in non-name as if he/she was the Defendant’s card.
However, the facts are that the defendant is not the legitimate holder, and even if he purchases the above goods, he did not intend to pay the price.
In the end, the Defendant, as such, deceivingd the Damarket employees, and then by deceiving the price of the goods from the employee, that is, by means of a card, by fraud.
3. On February 28, 2015, the Defendant attempted to commit fraud: (a) purchased goods of an amount equivalent to KRW 203,750,00, such as a disease, window, three disease, waste bags, etc. at “F south store” located in Gwanak-gu in Seoul Special Metropolitan City, Gwanak-gu, Seoul, and (b) presented a card that he acquired to an employee in default of his name and paid the price.
However, the facts are not the legitimate holder of the above card, but the defendant did not intend to pay the price even if he purchased the goods.
Ultimately, the Defendant, by deceiving an employee as above, attempted to settle the price of goods from the employee and defraud it, but failed to settle the price due to the suspension of the use of a marina card.
4. The Defendant in violation of the Specialized Credit Financial Business Act shall present a scar card, signed on sales slips and signed 9,800 won to the employees in non-name at the same date, time, and place as in paragraph (2).
