Defendant
A shall be punished by imprisonment with prison labor for eight months and by imprisonment for six months.
However, as to Defendant B, this shall not apply.
Reasons
Punishment of the crime
1. Joint crimes committed by Defendant A with D, E, and F;
A. The Defendant, the representative of G, which is a water tank cleaning service company, entrusted the periodic inspection of water quality of the water tank in large marinas, department stores, etc., and entrusted the periodic inspection of water quality of the water tank to H (H) by using the office tap water, etc. of H (H) without collecting water from the water tank, and demanded to issue a test report which is judged appropriate to the result of water quality inspection. D, and E, in response, ordered F, the employees of the above company’s general team, to obtain tap water from H (ju) toilets and enter it into the sample number as water, and then request the company’s analysis team to conduct water quality inspection.
Accordingly, on August 11, 2015, F entered into the H (State office) office of H without collecting the water quality sample from I, and ordered the staff J to “production”, and made J to inject the water collected from the toilet of H (State) company building in a container. However, F, as if it was normally able to complete, stated the number of samples and the date of samples, and requested the company analysis team to examine water quality and issue a test report which is judged appropriate to the result of water quality inspection on the 17th day of the same month.
In collusion with D, E, and F, the Defendant issued a false result of the examination in the same manner 43 times in total, such as the list of crimes (1) in attached Form 43 times from the above date to March 25, 2016.
(b) The owner or manager of a building or facility which uses a large quantity of tap water that obstructs the performance of public duties in a deceptive scheme shall take sanitary measures, such as disinfection of water supply facilities, and clean water tanks at least once a half year, and drinking water for the safe sanitary control of tap water at least once a year from the last inspection date;
