A Imprisonment with prison labor for six months, for four months, for defendant C, for eight months, and for six months, for defendant D respectively.
Reasons
Punishment of the crime
1. Defendant D, C, and A conspired to acquire insurance proceeds in the name of agreement against the insurance company affiliated with the other vehicle driver by intentionally violating signal or intentionally cause minor traffic accidents against the vehicle that changes the vehicle line, and by receiving hospitalized treatment despite minor shock of the risk of the traffic accident that occurred as above, Defendant D, C, and A, as a condition for early discharge.
A. On October 6, 2016, around 07:20, Defendant C was driving in the vicinity of the airspace conference located in Seo-gu, Seo-gu, Seo-gu, Gwangju, and Defendant C was intentionally caused a traffic accident by discovering and driving the G car from the fourth line to the third line.
Since then, after receiving an accident from the victim Han Lan Non-Life Insurance Co., Ltd., an insurance company for the said car, the Defendants filed a claim for insurance proceeds as if they suffered injuries due to normal traffic accidents caused by hospitalization at H oriental medical hospitals. However, the Defendants did not need to be hospitalized merely because they suffered minor injuries due to the said accident.
The Defendants, as above, deceiving the staff in charge of the victimized person as above, received the total amount of KRW 5,394,760,000 from the victimized person, including: (a) KRW 1.199,00 for Defendant D; (b) KRW 1.199,00 for Defendant C; and (c) Defendant A received KRW 1,067,090 for treatment expenses around October 26, 2016; (b) KRW 210,670 for the same name as around October 28, 2016; and (c) KRW 6.50,00 for the repair expenses of the said vehicle around October 17, 2016.
B. On November 11, 2016, at around 09:20, the Defendants are driving in the passenger car driven by K on the street in front of the J restaurant located in Gwangju Northern-gu, Gwangju, and the Defendants are driving in the same line and the said K has changed the car from the fourth line to the third line, and the kid is also finding the N car of M driving.
