Reasons
Punishment of the crime
On August 28, 2014, the Defendant was sentenced to one year of imprisonment for larceny by the Incheon District Court, and completed the execution of the sentence in the Incheon Detention House on April 8, 2015.
Criminal facts
1. On July 27, 2015, around 15:30 on July 27, 2015, the Defendant was at the victim D’s house located in Ansan-si Group C, Ansan-si, and the Defendant was able to purchase a house with the intent to steal the property after entering the house. The old room was that the Defendant entered the house through the F and the entrance of the head of the E Real Estate Office and the head of the E Real Estate Office in order to purchase the house. However, the Defendant left the house, but there was no other things that should be stolen.
Accordingly, the defendant invadedd the victim's residence and attempted to steals property.
2. Intrusion upon residence and theft;
A. At around 16:10 on July 27, 2015, the Defendant came to the house of the victim G located in Ansan-si Group C, Ansan-si, and even if he thought that he would steal the property, he was able to purchase the house by entering the house with the head of the E real estate office F and the head of the entrance door. On the other hand, the Defendant intruded into the house through the head of the E real estate office and colors the stolen property, and discovered a wall of KRW 20,000, a cash owned by the victim who was on his book, and USD 100,00,000, a new bank check card, and USD 30,000,000.
Accordingly, the defendant invadedd the victim's residence and stolen the victim's property.
B. At around 16:28 on July 27, 2015, the Defendant: (a) entered the house of the Victim H located in Ansan-si, Ansan-si, a member of the Dong-si, and had been scambling to purchase the house even if he thought of theft of the property by entering the house; (b) intruded into the house through the F and the entrance door of the head of the real estate office and colors the stolen property; (c) was influoring the stolen property; and (d) was influoring the victim’s house of the victim’s house with cash 160,000 won, which is owned by the victim within the bank of the victim’s house of the victim’s house; and (d) KRW 1,00,000,000, market price of the victim’s house.
