The defendant is not guilty. The summary of the judgment against the defendant shall be published.
Reasons
1. On August 8, 2012, the Defendant, at around 22:00, committed an indecent act by force against the victim E (the 53 years old and 53 years old) and sing in the “Dambs” located in Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-si.
2. In light of the following circumstances acknowledged by the record, it is difficult to believe that the entry of the E’s legal statement, E’s written statement, written statement, and written statement made from the Defendant at the time and place indicated in the facts charged, and there is no other evidence to prove the facts charged in the instant case.
① Upon submitting a written complaint on August 13, 2012, E submitted by the investigative agency, the Defendant stated to the effect that “the Defendant was unable to look at the chest in singing room and under the clothes” at the time when he was examined by the investigative agency. On December 21, 2012, the Defendant stated to the effect that “the Defendant was sent the chest by putting him into the brue,” and that “the Defendant was sent the chest by putting him into the brue when he was investigated into the brue,” and there is no consistency in the E’s statement of damage.
② At this Court stated to the effect that “E was singn out in sings, and the Defendant saw her chest into the clothes and singn out of the clothes, even though she was singn out, the Defendant she was singn out of the clothes.”
However, although five persons, including the Defendant and E, sing together at the time of the instant case, they do not seem to have observed the above indecent act of the Defendant.
③ The E asserts that he had been subject to the above indecent act by the Defendant in singing room. There was no resistance or demand from the Defendant on the job, and no other person doing an indecent act in the surroundings did not speak about the indecent act. Even after the point of time when he asserts that he was an indecent act, E was engaged in an indecent act with the Defendant including the Defendant without any particular color in singing room for a considerable period of time.
