A defendant shall be punished by imprisonment for five years.

Punishment of the crime

피고인은 그 과정에서 피해자로부터 “아파, 놔!”라는 말을 들었으나 피해자를 째려보듯이 인상을 쓰고 손을 들어 때릴 듯이 겁을 주어 피해자에게 옷을 벗고 그곳에 눕도록 한 후 피해자 위에 올라타 피해자의 음부에 성기를 삽입하였다.
