1. 피고인 A 피고인은 2020. 2. 19. 21:15경 광주 북구 D에 있는 ‘E’ 주점에서 술을 마시던 중 피해자 B(47세)와 그 일행인 C과 시비가 되어, 피해자의 얼굴과 머리 등을 주먹으로 수회 때려 바닥에 쓰러뜨리고, 계속하여 쓰러진 피해자의 얼굴과 머리 등을 수회 때리고, 이에 피해자가 그곳 테이블 위에 있던 맥주병을 피고인을 향해 던져 피고인의 머리 부위에 맞추자 피해자의 몸을 잡고 바닥에 뒹굴면서 피해자의 몸과 얼굴 부위 등을 주먹으로 수회 때렸다.
