1.The judgment of the first instance shall be modified as follows:

1. The court's explanation on this part of the basic facts is the same as the basic facts of Article 420 of the Civil Procedure Act, because the reasoning of the judgment of the court of first instance is the same as the basic facts of Article 420

2. The parties' assertion

A. The Defendant’s damage caused by the instant accident is merely KRW 6,00,00 in total, including KRW 1,255,750 in daily income, KRW 3,740,250 in future treatment expenses, KRW 704,00 in total, and KRW 300,00 in consolation money, and KRW 6,000 in total. As such, the Plaintiff’s insurance payment obligation against the Defendant due to the instant accident does not exist in excess of KRW 6,00 in total.

B. Since the Defendant suffered symptoms, such as Apology, vision disorder, timber and shoulder pain, and coding power phenomenon due to the instant accident, the Plaintiff is obligated to pay insurance proceeds of KRW 34,778,360 in total, KRW 360,70 in medicine expenses, KRW 8,067,660 in medical expenses, KRW 360,00 in hospital treatment and transportation expenses, KRW 4,750 in hospital treatment and transportation expenses, KRW 4,00 in future, KRW 3,000 in hospital treatment expenses, KRW 12,00,000 in compensation, KRW 3,778,00 in compensation, KRW 360 in total.

3. Determination

A. In a lawsuit seeking confirmation of non-existence of a monetary obligation, if the plaintiff, who is the debtor, denies the fact that the cause of the debt occurred by specifying the first claim, the defendant, the creditor, bears the burden of proving the fact that the legal relationship exists.
