1. The Plaintiff (Counterclaim Defendant) against the Defendant (Counterclaim Plaintiff)
A. Of the B 868 square meters in Yangju-si, indication 1, 2, 3, 4.
Reasons
1. Facts of recognition;
A. (1) The Defendant is the owner of B large-scale B large-scale 868 square meters and C large-scale 265 square meters (hereinafter “instant land”).
(2) The Plaintiff is the owner of a stable constructed on the ground of 214 square meters in part 175 square meters in the ship connecting each point in the attached Form 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 16-1, 17, 18, 18, 18-1, 19, 20, and 175 square meters in sequence, among the items in the attached Form 1, 2, 3, 4, 5, 6, 7, 9, 10, 17, 18, 18-1, 18-1, 19, 20, and 23-2, 22-1, 22, 221, 24-1, and 24.
(3) Of the instant housing and livestock sheds, the portion of the instant housing and livestock shed, which is owned by the owner of the instant land, excluding the portion of the instant land, which is owned by the owner of the instant land in sequence 171 square meters connected to each of the items in the table Nos. 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 12, 13, 14, 15, 16, 16-1, 18-1, 18-1, 19, 20, 24-2, 24-1, and 21 square meters in proportion to each of the items in the table No. 21, 22, 22-1, 22-2, 24-1, 24-2, and 24-1 of the drawings, is owned by the owner of the instant land within 15 square meters in succession.
B. On July 2, 1993, the Plaintiff entered into a lease agreement on the instant land (hereinafter “instant lease agreement”) with the Defendant for the purpose of owning the instant housing. The Plaintiff paid the Defendant one-year rice payment under the instant lease agreement, but paid three-year rice per annum from the construction of the instant stable, and paid KRW 700,000 per annum from 206 to 201, and KRW 80,000 per annum in 2012.
C. (1) On October 22, 2013, the Defendant converted the instant lease agreement into monthly rate of KRW 100,000 per month for the instant housing and KRW 2.50,000 per month for livestock penss, and KRW 150,000 per month for livestock penss. However, if the Plaintiff did not accept the instant lease agreement, it should not be accepted.
