1. Defendant B:

(a) Attached drawings (1), (2), (3), (4), (7), and (1) among the area of 714 square meters in Nam-gu, Chungcheongnam-gu, Seoul Special Metropolitan City.

1. Facts of recognition;

A. On October 5, 199, Defendant B leased and used D large 714 square meters (hereinafter “instant land”) and unregistered buildings not registered on the ground (hereinafter “instant building”) in Yandong-gu, Nam-gu, Dong-gu, Seoul (hereinafter “Seoul”) and purchased the instant building from E.

B. On June 21, 2002, Defendant C, a partner of Defendant B, was awarded the instant land in a compulsory auction procedure, and on July 2, 2002, Defendant B entered into a lease agreement stating that the instant land and the instant building are leased KRW 12 million to Defendant B.

C. On March 20, 2013, the Plaintiff was awarded a successful bid in the compulsory auction procedure and became its owner.

피고 B은 이 사건 토지상에 별지도면 표시 ①, ②, ③, ④, ⑦, ①의 각 점을 차례로 연결한 선내 ㉠-1 부분 약 20㎡ 경량철골조 판넬지붕 단층 숙소, 같은 도면 표시 ⑧, ⑨, ⑩, ⑪, ⑧의 각 점을 차례로 연결한 선내 ㉡부분 약 92㎡ 경량철골조 판넬지붕 단층 법당, 같은 도면 표시 ⑫, ⑬, ⑭, ⑮, ⑫의 각 점을 차례로 연결한 선내 ㉢부분 약 2.86㎡ 경량철골조 판넬지붕 단층 화장실, 같은 도면 표시 , , , , 의 각 점을 차례로 연결한 선내 ㉣부분 약 18㎡ 경량철골조 판넬지붕 주택(이하 위 지상물 일체를 ‘이 사건 건물 등’이라 한다)을 소유하고 있고, 그 밖에도 수목, 조경석 등을 소유하고 있다.

E. The amount equivalent to the rent from April 3, 2013 to November 16, 2018 of the instant land is as follows. The rent from November 17, 2018 is 225,530 won per month (i.e., KRW 121,380,000 x expected interest rate 2.2% ± 12 months).

2. Determination as to the claim against the defendant B

A. According to the above facts of determination as to the cause of the claim, Defendant B owned and used the instant land on the instant land owned by the Plaintiff.
