피고 인은 위 B, E 등과 공모하여, 2018. 1. 25. 경부터 2018. 3. 13. 경까지 위 게임 장에서, 게임 물관리 위원회의 등급 분류를 받은 것과는 다른 내용인, 게임용 IC 카드 이외에 별도의 외부장치( 리 더기 )를 이용하여 정산 카드( 마스터 카드 )를 게임기에 삽입하여 게임포인트 확인 및 초기화, 배경 화면에 랭킹 점수( 골드 포인트) 등이 표시되는 별도의 정산 창이 확인되도록 그 내용이 개 ㆍ 변조된 ‘ 뉴 백경 2017’ 게임 기 100대를 설치하여 놓은 다음, 그 곳을 찾아온 손님들에게 조작 버튼 위에 자동 연타 장치인 일명 ‘ 똑딱이 ’를 올려놓고 자동으로 게임을 하도록 하면서 손님들이 획득한 점수를 IC 카드에 저장되도록 하고, 환전을 요청 받을 경우 IC 카드에 저장된 점수 1점 당( 골드 포인트 1점 당 1만 원) 수 수료 10%를 공제한 9,000원을 환전하여 주었다.
