Defendants shall be punished by imprisonment for ten months.
However, from the date of the final judgment of this case, the defendants are above two years from the date of the final judgment.
Reasons
Punishment of the crime
1. No person who conducts speculative business using an Internet PC game shall engage in the business of providing Internet computer game facilities without registering with a competent authority, and no game products-related business entity shall allow customers to engage in gambling or other speculative business using game water, or leave them to cause them to engage in such gambling or other speculative business, and shall distribute or use game products which have not been rated;
Nevertheless, from June 28, 2016 to July 20:15, 2016, the Defendants installed seven computer units within the Gyeongjin-gun D, and E, without registering with the competent authorities, and deposited the said establishment to many unspecified customers by exchanging the points they acquired to the said operators to exchange them through the said operators. The Defendants provided ID and passwords necessary for accessing the said games (F, the Philippines server connection), i.e., the said games (G) without being classified by the Game Water Management Committee, and received cash or remittance from the said users, and deposited them to the account of the operator operating the said site. The Defendants deposited them into the said game room to enable them to display and play a game.
As a result, the Defendants engaged in the business of providing Internet computer game facilities without being registered in collusion, provided ungraded game water for use, and caused them to perform speculative acts by using game water.
2. In spite of the fact that a person providing the use of a physical posters game machine did not provide a game product for the distribution or use thereof, or display or store it for this purpose, the Defendants conspired in collusion and set up one physical posters game machine, which is a game product not classified by the Game Water Management Committee, at the date and place specified in paragraph 1, and at a large number of unspecified persons.
