A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

[criminal history] On May 24, 2017, the Defendant was sentenced to six months of imprisonment for fraud in the Incheon District Court’s Vice-Support, and completed the execution of the sentence at the Incheon Detention House on August 5, 2017.

The Defendant received 130,000 won from the victim’s bank account in the name of the Defendant on the same day, from that time until May 29, 2018, from that time, the Defendant received KRW 4,130,600 by deceiving the victims on 37 occasions, such as the list of crimes in the attached Table.

Accordingly, the defendant was informed of the victims to receive property.

[2018 Criminal facts] No person shall damage another person's information processed, stored, or transmitted through an information and communications network, or infringe, misappropriate, or divulge another person's secret.

On February 7, 2018, the Defendant: (a) made a false statement to the Victim J, who became aware of through the I game site on February 7, 2018, that “K would exchange the ID and password of the Account with one another; (b) inform the password of the Account on the main page; and (c) accessed the victim’s game account with the “L” password from the victim; and (d) arbitrarily changed the victim’s game account password to prevent the victim from accessing the game account.

Accordingly, the defendant damaged other's information processed and stored through the information and communication network.

[2018 high group 2514] No person shall intrude into an information and communications network without legitimate access authority or beyond permitted access authority.
