A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. On February 14, 2011, the Defendant made a false statement to the victim E, who became aware of at least 112 dong 405 and D Internet car pages in Ulsan-gu, Ulsan-si, Ulsan-si, that “The Defendant will guarantee profits by 200,000 won per day as 15,000 won and 100,000 won per day as a program. To establish a program, the Defendant would make a cash with a program with inside the limit of 15,000 won. In this case, the Defendant would guarantee profits by 200,000 won per day as 20,000 won as 10% as an investment amount per day.”

However, the Defendant did not have any futures option program that can make an average of 400,000 won per day, and there was no intention or ability to make 100% of the above investment funds after two months through the futures option program, even if the Defendant was to invest the victim’s money to any other person, and thus, did not receive any investment funds from the victim.

As such, the Defendant, by deceiving the victim as such, received KRW 5 million from the victim on February 15, 201, under the pretext of investment, from the victim.

2. On July 2013, 2013, 2071, 2071, 2071, i.e., name omitted (F director), name omitted (G director), i.e., the Defendant’s personal information by phoneing an apartment advertisement published in the daily information book to verify the apartment owner’s personal information.
