A defendant shall be punished by imprisonment for one year.

Punishment of the crime

The Defendant, by the year 2007, was in mind operating a private teaching institute and was not well-known to create a programed futures and options system that reduces losses and creates profits from around 2008, and around August 2009, the Defendant: (a) operated a futures and options investment company to the victim E through D; (b) acting as the one with the father’s assets; (c) was acting as the one with a building, and (d) did not have any personal income; (b) did not occur; (c) did not operate a futures and options investment company; and (d) had no family assets.

At the end of November 2009, the Defendant: (a) around the Gangseo-gu, Gangseo-gu, Seoul, the Gangseo-gu, the Gangseo-gu, Seoul, made an investment in a futures option automatic program; (b) thereby guaranteeing the principal and paying high profits to the victims; (c) so far, D has made an investment for a multi-year period; and (d) made an investment in the futures and options in the money invested in the past; and (c) made an investment in the money invested in the futures and options. Because of a few programs, any profits are made, and any profits are expected to result in a loss, to guarantee the principal and interest of each month; and (d) make a transaction using the futures and options system that has already been developed.

However, in fact, the defendant has yet to develop the futures and options system, and has not been engaged in normal futures and options transactions using it, and there was no way to create profits.

The Defendant, as such, made a false statement to the victim and received KRW 120 million from the victim’s account in total, including the sum of KRW 20 million on December 17, 2009, KRW 40 million on December 22, 2009, KRW 40 million on February 8, 2010, and KRW 20 million on April 26, 2010.

In this respect, the defendant deceivings the victim to take property.
