Reasons
Punishment of the crime
After purchasing five parcels of land, including Young-gun G, Gangwon-do, the victim F was prepared to open "H," a hospital specialized in cancer at the end, and the new construction of the ground building was suspended due to the lack of construction costs.
On July 2013, the Defendants made a false statement to the victim F that “The Defendants may receive a loan of at least five billion won as security after appraising the said seven lots of land located in the said hospital site and the land located in the territory of the Young-gun, Gangwon-do, and the land located in the territory of Young-gun, Gangwon-do, and the land located in the territory of Young-gun, Young-gun, Gangwon-do, and receive a loan of at least five billion won, referring to expenses incurred in appraisal and lending, and if the loan is not implemented, the costs shall be refunded.”
However, in fact, the Defendants did not know the building and its site suspended by the Corporation as a collateral because they did not properly carry out the loan-related business, and did not have the intent or ability to normally carry out the loan even if they were to use a considerable portion of the cost paid by the injured party for the purpose unrelated to appraisal and loan, etc., and there was no intention or ability to return the cost if the loan was not carried out.
The Defendants conspired to induce the victims as such, and acquired the total amount of KRW 76 million by directly receiving from the damaged person the total amount of KRW 10 million from each account on July 30, 2013, KRW 30 million on August 19, 2013, KRW 15 million on August 20, 2013, and KRW 100,000 on August 5, 2013, and KRW 20 million on August 28, 2013.
