1. Facts of recognition;

A. On May 27, 1968, Plaintiff A was sentenced to imprisonment with prison labor and six months and three years and six months of suspension of qualification for violating the National Security Act and violation of the former Constitution of the Republic of Korea (wholly amended by the Constitution of the Republic of Korea of October 27, 1980) on March 11, 1976 at the Gwangju High Court of Gwangju, for about six months after he was released from North Korea, to B seafarers who are the shippers of the wooden Shipping Bureau, by the guard of the North Korea in the coastal coast, and were released from North Korea for about six months.

(2) The President may temporarily suspend the freedom and rights of citizens provided for in this Constitution and take emergency measures with respect to the authority of the Government or the court. (3) When taking emergency measures under paragraphs (1) and (2), the President shall, without delay, notify the National Assembly thereof. (4) The President shall not be subject to judicial review. (5) The President shall cancel the Emergency Measures under paragraphs (1) and (2). (6) The National Assembly may, with the consent of a majority of all incumbent National Assembly members, recommend the cancellation of the Emergency Measures, and the President shall comply with the Presidential’s request, except in extenuating circumstances.
