Punishment of the crime
【Criminal Power】 On October 23, 2018, the Defendant was sentenced to eight months of imprisonment for fraud at the Seoul Western District Court, and the said judgment became final and conclusive on August 30, 2019.
【The Defendant was the representative director of the Dispute Resolution Co., Ltd., and C, a person who was the vice-director of the Loan System of D Bank E branch, and the Defendant, in collusion with C, F, etc., intended to obtain the above payment guarantee by forging the payment guarantee in the name of D Bank E branch of D Bank E branch (a guarantee amount of KRW 1 billion), etc., and acquired the said payment guarantee by borrowing KRW 700 million against the victim corporation G as security, and C, the Defendant and F, by forging the payment guarantee, etc., and by obtaining a forged payment guarantee from C, the Defendant and F, intended to play a role
1. Forgery of private documents;
A. A. From January 25, 2013, Co., Ltd. forged: (a) at the D Bank E branch in Jung-gu Seoul Metropolitan Government, “(State representative director), the Gangnam-gu Seoul Metropolitan Government J (corporate registration number K) director,” “D Bank E branch in the guarantor column,” “gold KRW 1,00,000 (Won 1,00,000)” in the performance guarantee column; (b) “from January 25, 2013 to April 24, 2013” in the debtor column; (c) “B representative director A (L); (L); (d) Jung-gu Seoul Metropolitan Government M; (e) the place of performance guarantee; and (d) the place of performance guarantee; and (e) the place of performance guarantee; and (e) the place of performance guarantee; and (e) the place of performance of the D branch in the name of D Bank; and (e) the place of performance guarantee; and
Accordingly, the Defendant, in collusion with C and F, forged a letter of payment guarantee in the name of the head of D and E branch office of D and D Bank without authority for the purpose of exercising rights and obligations.
B. “Face for the certificate of issuance guarantee” is forged C at the D Bank E branch located in H in Jung-gu Seoul, Jung-gu, Seoul on January 25, 2013, with a computer, “certificate of issuance” in the title column, “I, K, and the representative of G in the Guarantee Agency column.
