1. Basic facts

A. On August 2017, Defendant B awarded a contract for construction cost of KRW 23 million to Defendant C with respect to the construction cost of the instant remodeling work, and Defendant B paid KRW 15 million under the pretext of advance payment.

B. Around that time, Defendant C subcontracted the instant remodeling work cost to Defendant D (i.e., KRW 23 million for the instant remodeling work cost - KRW 4 million for the fees, etc. for Defendant C). As above, Defendant C paid KRW 11 million out of the total amount of KRW 15 million received from Defendant B ( KRW 6 million on August 25, 2017, KRW 5 million, and KRW 5 million on August 26, 2017) via the account in the name of G, the wife of Defendant C, as advance payment.

The intermediate payment of KRW 23 million of the construction amount: 15 million won, the remainder after the completion of the construction: All the remainder;

그 후 제1심공동피고 D은 원고에게 이 사건 리모델링 공사 중 샷시공사(이하 ‘이 사건 공사’라 한다)를 견적서 내용에 따라 공사대금을 지급하기로 약정하면서 재하도급주었고, 원고는 2017. 8. 30. 이 사건 공사를 완료하였다.
