1. 이 사건 공소사실의 요지는, 피고인은 2013. 01. 31. 13:16경 온라인 일간베스트 저장소 사이트(www.ilbe.com) ‘B 쇼핑몰 신고 진행상황’이라는 원글에 피고인의 모친 명의로 가입한 닉네임 ‘C’을 이용하여 불상자가 작성한 피해자에 대한 탈세 혐의가 인정된다는 위 사이트내 원글을 보고 피해자가 탈세를 한 것이 인정된다는 이유로 ‘이씨발년간이과세자였어 ㅋㅋㅋㅋㅋㅋ뱃장두둑하네ㅋㅋㅋㅋ좆같은년ㅋㅋㅋㅋㅋㅋ이년백퍼털림ㅋㅋㅋㅋㅋㅋㅋㅋㅋㅋㅋㅋㅋㅋㅋ간이과세자가 연매출 5억 말이안되는데 이년 일반사업자로 이미 바꿨을 듯 안그럼 좆되는거알텐데ㅋㅋㅋ’라는 글을 작성하여 피해자 B(84년생,여)을 공연히 모욕하였다는 것이다.

2. This is an offense falling under Article 311 of the Criminal Act, which is subject to victim's complaint under Article 312 of the same Act. Since the victim B expressed his/her intent not to have the Defendant revoked and be punished on July 9, 2013 after the instant prosecution was instituted, the instant prosecution is dismissed in accordance with Article 327 subparagraph 5 of the Criminal Procedure Act.
