The prosecution of this case is dismissed.

1. 이 사건 공소사실의 요지는, 피고인은 2013. 5. 23. 00:53경 부천시 원미구 B에 있는 C식당앞 도로에서, ’피고인이 도로에 누워있어 위험하다‘라는 112 신고를 받고 출동한 피해자인 부천원미경찰서 소속 경장 D에게, 행인 E 등이 듣고 있는 가운데, 도로에 누워 잠을 자고 있는 피고인을 깨웠다는 이유로, ”야이, 개새끼들아! 이 씹새끼야, 너희 짭새 새끼들이 왜 날 깨우느냐, 또라이 새끼, 난 짭새가 싫다, 너희들 가만히 안 둘 것이다“라고 욕설하여 공연히 피해자를 모욕하였다는 것이다.

2. This is an offense falling under Article 311 of the Criminal Act, which is subject to victim's complaint under Article 312 of the same Act. The victim D, after institution of the instant prosecution, expressed his/her intent to revoke the complaint and not to want punishment on July 8, 2013. Thus, the instant prosecution is dismissed in accordance with Article 327 subparagraph 5 of the Criminal Procedure Act.
