A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

On January 24, 2011, the Defendant issued a summary order of KRW 2 million for a crime of violating the Road Traffic Act at the Incheon District Court, and a summary order of KRW 4 million for a crime of violating the Road Traffic Act at the Incheon District Court on July 12, 2013.

1. The Defendant is a person who is engaged in driving a cruise car in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes.

On November 04, 2016, around 17:30 on November 17, 2016, the Defendant proceeded along the three-lane road in Yeonsu-gu Incheon Metropolitan City, Incheon, along the one-lane from the right edge to the right edge of the road.

A person engaged in driving of a motor vehicle has a duty of care to accurately operate steering the steering gear and brakes and to maintain safety distance with the vehicle in front and to prevent accidents by driving the motor vehicle.

Nevertheless, the Defendant neglected this, while driving the pertinent cruise vehicle under the influence of alcohol content of 0.10% due to his negligence, led to a driver behind the pertinent cruise vehicle driven by the victim E (60 years old) in front of the pertinent cruise vehicle, and thereby, led the victim G (WW 42 years old) with the victim G (WW 42 years old) in front of the said passenger vehicle, and led the driver to a driver after the said passenger vehicle driven by I as the front driver of the said passenger vehicle, and led the victim K (63 years old) to a driver.

Ultimately, the Defendant driving the said cruise car in a situation where it is difficult to drive the car normally due to influence of drinking, and driving the said cruise car to the victim E, who is the driver of the said brand, for approximately two weeks of medical treatment, and inflicted an injury on the climatic base, which requires approximately two weeks of medical treatment on the victim G, who is the driver of the said climatic car, on the part of the above climatic base, and on the part of the victim, who is the passenger of the said clilar (n, 44 years of age).
