A shall be punished by a fine of 50,000 won, and a fine of 300,000 won, respectively.

The above fines are imposed by the Defendants.

Punishment of the crime

No person shall detached a registration number plate and a seal attached to a vehicle, except in cases where permission is obtained from the Mayor/Do Governor or where special provisions exist in other Acts.

Nevertheless, at around 08:21 March 15, 2019, the Defendants conspired to remove the F25 tons of cargo vehicles front and rear the registration number plate in front and rear by E at the upstream of the D Company located in C at the close end of the D Company in C.

Although Defendant B denies the instant crime, Defendant B took part in the act of removing the registration number plate at the time when Defendant A removed the registration number plate on the criminal facts, it is recognized that Defendant B took part in the act of removing the said registration number plate along with Defendant A, by means of the following: (a) the instant legal and investigative agency’s statement; (b) the photograph photographing the scene of the crime at the time of the occurrence of the registration number plate on the criminal facts; and (c) the photograph photographing the scene at the time of the removal of the registration number plate.

Therefore, Defendant B’s rejection of the crime cannot be accepted.

On the other hand, Defendant A expressed some questions about the establishment of the instant crime, such as seeking answers to the person in charge of the vehicle registration office at the time of removing the above registration number plate and claiming to the effect that the above registration number plate was removed. However, according to the evidence duly adopted and investigated by this court, Defendant A expressed the following circumstances, i.e., ① the person in charge of the vehicle registration office in Kimhae-si, who is in charge of the vehicle registration office, in the telephone call with the investigative agency around April 2019, when asked in extenuating circumstances, such as large vehicles, etc., the vehicle number plate should be returned or issued, and the vehicle number plate should be attached to the vehicle on the same day.
