Reasons
Punishment of the crime
1. On May 2018, Defendants were registered as owned by Defendant A and F, the head of Defendant B, under the joint name of Defendant A and her mother, around November 2017, under the lease of Defendant A’s female job-friendly C and her mother. However, Defendant B intentionally caused a traffic accident by using the GLC car operated by Defendant B, but the Defendants conspired to acquire insurance proceeds under the pretext of repair cost, medical expenses, agreement, etc. by deceiving the insurance company as if the traffic accident occurred, by intentionally causing a traffic accident by using Defendant B’s GLC car operated by Defendant B.
According to the above public offering, Defendant B operated the said passenger vehicle in the “I” parking lot located in Gui-si, Sin-si, Gui-si, Ha on May 5, 2018, and Defendant B claimed insurance proceeds to the victim J, Inc., as if the traffic accident occurred due to negligence following the receipt of the said part of the passenger vehicle in advance parked by Defendant A.
The Defendants deceiving the employees of the victimized company as above, and transferred 14,00,000 won to the L bank account under the name of the Defendant’s birth under the agreement on June 20, 2018, Defendant A received 3,800,000 won from the M bank account under the name of the Defendant’s birth under the name of the Defendant’s birth, and received 3,80,000 won under the name of the said C as repair expenses for non-repair, and had the employees of the victimized company pay 1,034,590 won to the N Hospital as medical expenses for Defendant A on July 16, 2018, and paid 15,110 won to theO as medical advisory expenses for Defendant A on August 6, 2018.
As a result, the Defendants conspired, by deceiving the insurer with respect to the occurrence, cause, or content of the insured events, acquired insurance proceeds of 18,834,590 won or had a third party acquire insurance proceeds.
2. Defendant A, around 14:44 on May 8, 2018, was driven by Defendant A while driving the said Ebents GLC car in the street near Songpa-gu Seoul P.
