Reasons
1. Basic facts
A. Plaintiff A is a person who was engaged in construction machinery driving business on or around April 2018; Plaintiff B is the wife of Plaintiff A, Plaintiff C, D, and E. The children of Plaintiff A.
B. On April 4, 2018, Plaintiff A, at around 16:20, entered the Defendant’s workplace, he/she loaded a truck while carrying out the ordinary car work to load tin in the truck, and the upper part of the loading box was caused by high voltage wire (hereinafter “instant accident”).

A due to the instant accident, A suffered injury, such as video, left-hand hand, and hand-on 3 degrees of video, left-hand hand and hand-on 5 degrees of video, cut-out windows around the left-hand hand, anti-speaking of both sides, anti-speaking of both sides, anti-speaking of anti-speaking of both sides, and a reflect of building a hand-book on the left-hand hand.
C. G who was a chief of the Defendant’s on-site manager in charge of managing the workplace facilities, and H, who was in charge of shipping the tin, etc. as the chief of the Defendant’s headquarters, was charged with the following crimes in relation to the instant accident (Cheongju District Court Decision 2019No. 94), and was convicted of both injury by occupational negligence and injury (Cheongju District Court Decision 2019No. 94), and the said conviction was finalized.
1. G and H’s occupational injury G is, around February 2018, by embling stone on the floor to use part of the workplace as a camping site, the distance between high-tension cable and ground installed in the airspace above the existing workplace was narrower than the previous one. As a result, if a driver loaded a stone on the ground in the tin-to-land work process, a part of the body is likely to contact high-tension cable.
In the above workplace, the average of 20 to 30 truck drivers were entering the workplace and transported tin in accordance with H’s direction, and in the case of drivers who do not belong to the defendant, the view that they reside in the workplace was short, so the existence of high voltage wires and the rise in the ground is attributable to high voltage wires.
