The prosecution of this case is dismissed.

1. The summary of the facts charged is between Defendant A (52 years of age, South) and the victim B (42 years of age, women) who are not living together.

At around 17:45 on March 13, 2020, the Defendant: (a) told the Defendant and the Victim Kim Jongpo-si that the Defendant was “Badin” on the grounds that the Defendant got her money from the previous telephone before his father D’s residence; and (b) assaulted the Victim’s head, leading, and pushed her head by his hand.

2. Determination

(a) Applicable provisions of Acts: Article 260 (1) of the Criminal Act;

(b) Crimes of non-compliance with an intention;

C. On November 17, 2020, after the prosecution of this case, a written application for non-prosecution of punishment, stating the victim B's intent not to punish the defendant on November 17, 2020

(d) Judgment dismissing public prosecution: It is so decided as per Disposition for the reasons under Article 327 subparagraph 6 of the Criminal Procedure Act.
