A defendant shall be punished by imprisonment for two years.

The defendant shall be ordered to complete a sexual assault treatment program for 40 hours.

Punishment of the crime

On February 1, 2015, the Defendant: (a) inducedd the victim, while communicating with the victim C (here, 12 years of age) through a “connection with an string of smartphone,” and “Rain,” which is a smartphone-rating display, to buy a white house with the victim; and (b) led the victim directly in the vicinity of the Busan Jin-gu Busan apartment, Busan, a residence of the victim, around 16:00 on the same day.

1. 미성년자의제강간미수 피고인은 위와 같이 피해자를 만나 자신이 운전해 온 에쿠스 승용차에 피해자를 태워 부산 부산진구 양정동 일대 및 동래구 일대를 운전하여 돌아다니다가, 2015. 2. 1. 20:00경 부산 금정구 E 소재 ‘F’ 인근 금정산성 순환도로변에 차량을 주차한 후 차량 조수석에 앉아 있던 피해자의 외투를 잡아당겨 피해자의 입술을 핥고 상의 속으로 손을 집어넣어 가슴을 만지고, 피해자의 바지를 한 쪽만 벗긴 후 피해자의 음부에 자신의 성기를 삽입하려 하였으나 뜻대로 삽입이 되지 않아 미수에 그쳤다.

Around February 1, 2015, the Defendant continued to engage in rape with a minor on the part of the victim, 21:30, around February 21, 2015, the Defendant had sexual intercourse by inserting his/her fingers into the part of the victim’s clothes, by inserting his/her fingers into the part of the victim’s sound, and inserting his/her fingers from the part of the victim’s body.
