나. 성폭력범죄의처벌등에관한특례법위반(장애인준강간등) 1) 피고인은 2013. 10. 중순 16:30경 피해자와 함께 위 초록공원 뒤편 숲 속에 이르러 그곳 계곡에서 소변을 보는 피해자의 음부를 쳐다보고, 계속하여 피해자를 바위 위에 눕히고 바지와 속옷을 벗긴 다음 피해자에게 “다리를 벌려라”고 말하고 피해자의 음부에 성기를 삽입하였다. 이로써 피고인은 정신적인 장애로 항거불능 상태에 있음을 이용하여 피해자를 간음하였다. 2) 피고인은 같은 날 18:00경 성관계가 끝난 후 피해자에게 “배 안 고프나, 냉면 사줄게”라고 말하며 초록공원에서 피해자를 데리고 내려온 후 반여동 인근 식당으로 피해자를 데리고 가 냉면과 커피를 사주는 등 환심을 샀다.
