Defendant

A is a director and director of the J Foundation, a social welfare foundation in Gyeonggi-si I, and Defendant C is a person who served as the secretary general of the said Foundation from around 2005 to April 2010, and Defendant B is a person who operates the said Foundation in E-si.

Although Defendant A and Defendant C submitted supporting materials as to such construction cost and received subsidies, they submitted a false contract with the excessive amount of 9,6250,000,000 won for electrical fire-fighting construction cost, in order to obtain subsidies, and asked Defendant B to prepare a construction contract with the excessive amount of construction cost, and Defendant B, despite being aware that Defendant B received subsidies in accordance with the excessive amount of construction cost, did not prepare and deliver a written contract for construction work, a written request for construction cost, a tax invoice, etc. stating 9,6250,000 won for the excessive amount of construction cost.

A and Defendant C submitted a request for advance payment of KRW 24,00,000, in addition to the above contract for electrical fire-fighting construction works, to Echeon Social Welfare and Public Officials in Charge of Echeon-si, Leecheon-si, Gyeonggi-do on November 20, 2006, together with the above contract for electrical fire-fighting construction works, and submitted a request for advance payment of KRW 24,062,00,00, in trust with true documents around November 23, 2006, remitted subsidies of KRW 24,062,00 (State subsidies of KRW 12,031,00), from Echeon-si, 207;
