A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendant is a person who engages in the business of selling used cars under the trade name of "C" located in Daegu Northern-gu B and 106.

1. Forging a private document;

가. 피고인은 2017. 3. 1. 위 C 사무실에서 D에게 E 쏘울 자동차를 판매하면서 사단법인 F의 중고자동차 성능상태 점검을 거치지 않았음에도 그곳에 있는 펜을 이용하여 중고자동차 성능상태 점검기록 부의 검사 항목 중 ‘ 양호’, ‘ 없음’ 등의 란에 ‘∨’ 표시를 하고, 점검 일자란에 ‘2017 년 2월 27일’ 이라 기재하고 중고자동차 성능ㆍ상태점검자란에 ‘G ’라고 기재하고, ‘C’ 가 새겨진 고무 명판을 찍었다.

나. 피고인은 2017. 3. 25. 경 위 C 사무실에서 H을 대리한 I에게 J 소나타를 판매하면서 사단법인 F의 중고자동차 성능상태 점검을 거치지 않았음에도 그곳에 있는 펜을 이용하여 중고자동차 성능상태 점검기록 부의 검사 항목 중 ‘ 양호’, ‘ 없음’ 등의 란에 ‘∨’ 표시를 하고, 점검 일자란에 ‘2017 년 3월 24일’ 이라 기재하고 중고자동차 성능ㆍ상태점검자란에 ‘G ’라고 기재하고, ‘C’ 가 새겨진 고무 명판을 찍었다.

Accordingly, the Defendant forged a record of the performance inspection of used cars in the name of F, an incorporated association, which is a private document on fact certification for the purpose of exercising over twice.

2. Exercising the relevant investigation document;

A. At the time and place indicated in paragraph 1(a), the Defendant presented the record of inspection of performance status of used cars in the name of F, an incorporated association, as if it were a document that was duly formed with D, and exercised it.

B. At the time and place specified in Paragraph 1-B(b), the Defendant presented the record of the performance inspection of used cars in the name of F, an incorporated association, as if it were a document duly formed with H, and exercised it.

3. A motor vehicle dealer who violates the Motor Vehicle Management Act shall have the structure and devices of the motor vehicle;
