1. The part against the defendant regarding the disposition of imposition of penalty surcharge in the judgment of the court of first instance shall be revoked, and the revocation part shall be revoked.
Reasons
1. In the first instance court, on May 17, 2016, the Plaintiff sought revocation of the imposition of a penalty surcharge, disposition of suspension of qualification by the president, disposition of return of subsidies, disposition of collection of unjust enrichment, disposition of corrective order, disposition of imposition of a fine for negligence, and the disposition of notification of the person subject to the violation of the Infant Care Act committed by the Defendant to the Plaintiff on June 30, 2016. The first instance court cited the part of each of the above claims seeking revocation of the disposition of imposition of a penalty surcharge and the claim seeking revocation of the notification of the person subject to the notification of the violation of the Infant Care Act, and sentenced
On the other hand, only the defendant appealed against the part of the judgment of the court of first instance ordering the revocation of the above imposition of penalty surcharge.
Therefore, the subject of this court's judgment is limited to the claim seeking revocation of penalty surcharges.
2. Details of the disposition;
A. From June 2, 1998, the Plaintiff is the representative and the president who is operating C Child Care Center B in Daegu-gu with the authorization of childcare facilities from the Defendant (hereinafter “instant Child Care Center”).
B. On or around February 3, 2016, the Defendant was informed of the violation committed by the Child Care Center in the instant case or of the violation committed by the Korea Infant Care Agency and Daegu Metropolitan City.
