1. 피고인은 2019. 7. 21. 19:37경부터 20:15경까지 조합원들 약 750여명이 포함되어 있는 단체 카카오톡 채팅방에서 "D"이라는 닉네임을 이용하여 "아 정말 똘아이 새끼들이네요, 조합애들이 미쳤어요, 글들을 다 지우고 있네요, 도대체 이런 멍청한 짓을 하는 인간들 얼굴이 궁금하네요. ㅋㅋㅋ, 정말 쓰레기의 끝을 보네요, 총회날 확성기 마이크 한번만 쓸게요, 카페 활동 정지당했으니까요.ㅋㅋㅋ" 라고 채팅방에 글을 작성하여 공연히 피해자를 모욕하였다.
