피고인은 2012. 9. 19.경 평택시 B에서 아래와 같이 특허청 등록상표 내역에 기재 된 루이비똥, 샤넬 등의 상표를 위조하여 부착한 루이비똥 가방 80점, 지갑 20점, 샤넬 가방 10점, 지갑 2점, 프라다 가방 10점, 구치 가방 5점, 지갑 2점, 버버리 가방 10점, 코치 가방 70점, 지갑 8점, 헤르메스 가방 10점 등 위조 상품 총 227점 (판매시가 8,280,000원 상당, 정품추정시가 222,828,000원 상당)을 양도 또는 인도하기 위하여 소지함으로써 해당 상표권자의 상표권을 각각 침해하였다.
