피고인은 2012. 6.경 피고인의 스마트폰(B)에 채팅 앱 'C'을 설치하고, 2012. 8. 9. 00:59 서울 중구 D건물 지하 4층에 있는 피고인 회사의 기사대기실에서 'C'의 '서울14' 채팅방에 접속하여 아동청소년 E(여, 16세)에게 “쉿! 고민/대화, 매너 조.건 28 살 180 78 ◀◀◀”이라는 내용으로 아동청소년에게 성을 팔도록 권유하는 메시지를 전송한 것을 비롯하여 다음 범죄일람표 기재와 같이 위 일시경부터 2012. 8. 12. 21:34까지 모두 13회에 걸쳐 불특정 다수의 아동ㆍ청소년에게 성을 팔도록 권유하는 문자메시지를 전송하였다.
